These Terms & Conditions of Use (“Terms”) govern your access to and use of nepaliteatraders.com (the “Site”) and any purchases you make from Nepali Tea Traders, LLC (“Nepali Tea Traders,” “we,” “us,” or “our”). By accessing, browsing, or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
We are an online-only store located in Massachusetts, USA. If you access the Site from outside the U.S., you are responsible for compliance with local laws.
You must be at least 18 (or the age of majority in your jurisdiction) to use the Site. You are responsible for keeping your account credentials confidential and for all activity under your account. Provide accurate and current information.

We may refuse, limit, or cancel any order at our discretion, including suspected fraud or violations of these Terms. Prices, promotions, and availability are subject to change without notice. Applicable taxes and shipping are calculated at checkout.
Risk of loss/title. Title and risk of loss transfer to you when we deliver items to the carrier.

We try to be accurate, but descriptions, images, and prices may contain errors or vary (e.g., tea appearance can vary by harvest). If a product you receive is not as described, your sole remedy is to return it in unused condition per our Returns Policy.
Promotions are subject to specific terms and may end at any time. Promotions cannot be applied retroactively. Gift cards and store credit are not redeemable for cash (unless required by law).
All content on the Site—including text, images, logos, graphics, and code—is owned by Nepali Tea Traders or its licensors and is protected by copyright and trademark laws.
We grant you a limited, non-exclusive, non-transferable license to access and make personal, non-commercial use of the Site. This license does not include any right to:
Download, reproduce, modify, or distribute the Site or its content (other than page caching)
Use data mining, robots, or similar data-gathering tools
Resell products or commercially exploit any portion of the Site or its content
Frame or use framing techniques or meta tags using our trademarks or trade dress
Any unauthorized use terminates this license.
If you submit reviews, photos, or other content (“User Content”), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display such content in any media. You represent that you own or control the rights to your User Content and that it does not violate any third-party rights or laws. We may remove User Content at any time.
You agree not to:
Violate any law or the rights of others
Post unlawful, defamatory, obscene, or infringing content; or spam
Access or attempt to access areas of the Site without authorization
Interfere with the Site’s operation (e.g., upload malware, overloading, scraping)
Use the Site for commercial purposes not expressly permitted by us
The Site may link to third-party websites or use third-party tools (e.g., payments, analytics). We are not responsible for third-party content, policies, or practices.
THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEPALI TEA TRADERS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO US FOR PRODUCTS IN THE 12 MONTHS BEFORE THE CLAIM.
Some jurisdictions do not allow certain limitations; those limits apply only to the extent permitted by law.
You agree to defend, indemnify, and hold harmless Nepali Tea Traders and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or misuse of the Site.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles and not including the U.N. Convention on Contracts for the International Sale of Goods. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Boston, Massachusetts.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the effective date. Your continued use of the Site constitutes acceptance of the updated Terms.
If any provision is held invalid, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset sale. These Terms, together with referenced policies, are the entire agreement between you and us regarding the Site.
